Clients remain free to accept, reject, or interpret spiritual or metaphysical concepts according to their own beliefs and experiences.
3.NOT MEDICAL OR MENTAL-HEALTH CARE
SAKAPE DOES NOT PROVIDE MEDICAL CARE, PSYCHOLOGY, PSYCHIATRY, PSYCHOTHERAPY, MENTAL-HEALTH COUNSELING, MEDICAL DIAGNOSIS, OR OTHER LICENSED HEALTHCARE SERVICES UNLESS EXPRESSLY STATED OTHERWISE.
Nothing provided through SAKAPE should be interpreted as medical or mental-health advice, diagnosis of a physical or psychological condition, prescription, recommendation concerning medication, or substitute for care from an appropriately qualified healthcare professional.
Client agrees not to discontinue, delay, replace, or modify prescribed medication, medical treatment, mental-health treatment, or other professional care based solely upon a SAKAPE session or communication.
Questions concerning physical or mental health should be directed to an appropriately qualified healthcare professional.
4.No Diagnosis, Treatment, Cure or Prevention
SAKAPE does not represent that its services diagnose, treat, cure, prevent, eliminate, or medically improve any disease, disorder, injury, medical condition, or psychological condition.
Participation in SAKAPE services should not be used as a replacement for appropriate medical, psychological, psychiatric, therapeutic, or other licensed professional care.
5.NO GUARANTEE OF RESULTS
INDIVIDUAL EXPERIENCES VARY. NO SPECIFIC RESULT OR OUTCOME IS PROMISED OR GUARANTEED.
SAKAPE makes no guarantee concerning physical, emotional, psychological, spiritual, energetic, relationship, fertility, financial, career, business, legal, or other outcomes.

Client acknowledges having had the opportunity to review this Agreement and ask questions before participating.
7.Personal Responsibility
Client remains responsible for Client's own decisions, actions, health, safety, choices, and well-being.
Information, intuitive impressions, spiritual observations, suggestions, interpretations, or other communications offered during a SAKAPE service are provided for spiritual, educational, or personal-exploration purposes only.
Client is responsible for determining whether and how to act upon such information.

Experiences may include relaxation, emotional responses, memories, heightened awareness, fatigue, temporary discomfort, or other personal experiences.
Client understands that outcomes and individual reactions cannot be predicted.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CLIENT KNOWINGLY AND VOLUNTARILY ASSUMES THE ORDINARY AND REASONABLY FORESEEABLE RISKS ASSOCIATED WITH CLIENT'S VOLUNTARY PARTICIPATION IN SAKAPE SERVICES.

9.IMPORTANT — RELEASE OF LIABILITY, INCLUDING ORDINARY NEGLIGENCE
THIS SECTION AFFECTS YOUR LEGAL RIGHTS. PLEASE READ IT CAREFULLY BEFORE ACCEPTING THIS AGREEMENT.
To the fullest extent permitted by applicable law, Client voluntarily releases and agrees not to hold liable SAKAPE and its owner(s), practitioner(s), employees, independent contractors, agents, representatives, affiliates, successors, and assigns from claims for injury, loss, damage, cost, or expense arising out of or relating to Client's voluntary participation in SAKAPE services, INCLUDING CLAIMS BASED UPON THE ORDINARY NEGLIGENCE OF A RELEASED PARTY, TO THE EXTENT SUCH CLAIMS MAY LAWFULLY BE RELEASED.
Client acknowledges that this provision is intended to constitute an express release of claims based upon ordinary negligence to the maximum extent permitted by applicable law.
THIS AGREEMENT DOES NOT RELEASE, EXCLUDE, OR LIMIT LIABILITY FOR WILLFUL OR WANTON CONDUCT, GROSS NEGLIGENCE WHERE IT CANNOT LAWFULLY BE WAIVED, FRAUD, INTENTIONAL MISCONDUCT, OR ANY OTHER LIABILITY OR LEGAL RIGHT THAT APPLICABLE LAW DOES NOT PERMIT THE PARTIES TO WAIVE OR LIMIT.
Nothing in this Agreement is intended to deprive Client of any mandatory legal or consumer right that cannot lawfully be waived.
10.Emergency and Crisis Situations
SAKAPE IS NOT AN EMERGENCY OR CRISIS SERVICE.
SAKAPE does not provide emergency medical treatment, emergency mental-health treatment, suicide-prevention services, or crisis intervention.
If Client is experiencing or believes they may be experiencing a medical, psychological, psychiatric, or other emergency, Client should contact emergency services or an appropriately qualified professional where Client is physically located.

Client understands that laws governing spiritual, holistic, wellness, privacy, consumer, and related services vary between countries, states, provinces, territories, and other jurisdictions.
Client agrees to accurately provide Client's country and state, province, territory, or region of physical location when reasonably requested.
SAKAPE reserves the right to decline, restrict, postpone, or discontinue services where SAKAPE reasonably determines that providing a service may be prohibited, restricted, unsafe, inappropriate, or outside the intended scope of SAKAPE's services.
12.Governing Law and Mandatory Local Rights
To the fullest extent permitted by applicable law, this Agreement and disputes concerning SAKAPE services shall be governed by the laws of the State of Colorado, United States, without regard to conflict-of-law principles.
However, SAKAPE recognizes that clients participating from other jurisdictions may possess mandatory consumer, privacy, contractual, or other legal rights that cannot lawfully be waived by agreement.
Nothing in this Agreement is intended to eliminate, restrict, or waive a right or protection that applicable law does not permit the Client to waive.
13.Privacy and Personal Information
SAKAPE may collect information reasonably necessary to operate its business and provide services, including Client's name, contact information, country or region, appointment information, communications, transaction information, and information Client voluntarily chooses to provide.
SAKAPE seeks to collect only information reasonably necessary for legitimate business and service purposes.
Personal information may be used to provide and administer services, schedule appointments, process payments, communicate with clients, maintain appropriate records, operate the website, satisfy legal obligations, and protect SAKAPE and its clients.

14.Sensitive Personal Information
Where SAKAPE requests information that constitutes sensitive personal data under applicable law, such information will be processed in accordance with applicable legal requirements.
Where legally required, separate affirmative consent will be requested before sensitive personal information is processed.
SAKAPE will not treat acceptance of this entire Agreement, standing alone, as sensitive-data consent where applicable law requires separate consent.
15.Confidentiality
SAKAPE will make reasonable efforts to respect the privacy of information clients share during sessions.
Client understands, however, that SAKAPE is not representing itself as a physician, psychologist, psychotherapist, attorney, or other licensed professional whose communications may receive a particular legally recognized professional privilege.
Information may be disclosed when Client authorizes disclosure or where disclosure is required by applicable law, court order, or valid legal process.
16.Technology and Electronic Communications
Remote services may depend upon third-party technology, including website hosting, scheduling platforms, payment processors, video-conferencing systems, email, messaging services, cloud services, and similar providers.
SAKAPE may take reasonable precautions to protect information but cannot guarantee that internet-based communications or third-party systems will be completely secure, uninterrupted, or error-free.
17.Payment, Cancellation, Rescheduling and Refunds
Client agrees to the pricing and applicable Cancellation, Rescheduling & Refund Policy disclosed at or before purchase.
SAKAPE may establish different policies for individual sessions, group sessions, events, courses, digital products, physical products, packages, memberships, or other offerings.
Nothing in SAKAPE's policies eliminates refund, cancellation, withdrawal, or other consumer rights that cannot legally be waived under applicable law.
18.Intellectual Property
Unless otherwise stated, SAKAPE's original website content, written materials, exercises, graphics, recordings, courses, programs, digital materials, branding, and other proprietary materials remain the property of SAKAPE or their respective rights holders.
Client may not reproduce, distribute, sell, commercially exploit, publish, or create unauthorized recordings of SAKAPE services or proprietary materials without prior authorization.
19.Recording of Sessions
Client may not audio-record, video-record, photograph, screen-record, or otherwise record a private or group SAKAPE session without prior authorization.
SAKAPE will not record a private Client session without appropriate notice and consent.
20.Adults Only

By entering into this Agreement, Client represents that Client is at least 18 years old and has legal capacity to enter into this Agreement.
21.Right to Decline or Discontinue Services
SAKAPE reserves the right to decline, postpone, terminate, or refer a Client elsewhere when reasonably appropriate, including where a requested service falls outside SAKAPE's scope, where continued participation may be inappropriate, where Client behavior creates safety concerns, or where applicable law or policy makes providing the service inappropriate.
22.Severability
If any provision of this Agreement is determined by a court or other competent authority to be unlawful, invalid, or unenforceable, that provision shall be limited, modified, or severed only to the minimum extent necessary, where legally permitted.
The remaining provisions shall continue in effect to the fullest extent permitted by applicable law.
23.No Waiver
A failure by SAKAPE to enforce a provision of this Agreement on one occasion does not constitute a waiver of that provision or SAKAPE's right to enforce it in the future.
24.Entire Agreement
This Agreement, together with the SAKAPE policies expressly incorporated or presented in connection with the applicable transaction — including the Privacy Policy and Cancellation, Rescheduling & Refund Policy — constitutes the agreement concerning Client's participation in the applicable SAKAPE service, subject to rights that cannot legally be waived.
25.Electronic Acceptance and Records

Where permitted by applicable law, Client's electronic signature or affirmative electronic acceptance is intended to have the same effect as signing a written agreement.
